SMS Messaging Terms & Compliance

1. Program Description

This messaging program sends inquiry follow-up, consultation scheduling, and project status messages to prospective clients and clients who have submitted an inquiry through the Site or our chat widget and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox or affirmative consent statement. Messages include inquiry acknowledgements, appointment confirmations, scheduling updates, and other communications related to your project.

2. Cancellation Instructions

You can cancel the SMS service at any time. Simply text “STOP” to the same number that sent you messages. Upon sending “STOP,” confirmation of unsubscribe status will be sent via SMS. Following this confirmation, you will no longer receive SMS messages. To rejoin, sign up as you did initially, and messaging will resume.

3. Support Information

If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance, or reach out directly to steve@stevecuryconstruction.com or call (561) 207-6190 during business hours, Monday through Friday, 9 am – 6 pm ET.

4. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates

Message and data rates may apply for messages sent and received. Message frequency varies based on the stage and activity of your project inquiry. For questions about your text plan or data plan, contact your wireless provider.

6. Supported Carriers

The SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

7. Age Restriction

You must be 18 years or older to participate in the SMS program.

8. Privacy

For privacy-related inquiries, refer to our Privacy Policy. The Company complies with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and CTIA guidelines, regarding the use of SMS communications.

General Terms of Service

About Palm Beach Build

“Palm Beach Build” is a campaign and marketing identity of SEC Construction & Development, Inc. DBA Steve Cury Construction, a Florida corporation. Any contract, proposal, or estimate furnished through the Site or in connection with services described on the Site is between you and SEC Construction & Development, Inc., not the “Palm Beach Build” brand identity.

Intellectual Property Rights

Unless otherwise indicated, the Site and all content and materials on the Site — including the Palm Beach Build logo, the Steve Cury Construction name and logo, all designs, text, graphics, photographs of completed and in-progress projects, renderings, plans, information, data, software, sound files, other files, and the selection and arrangement thereof (collectively, “Site Content”) — are the proprietary property of the Company or its licensors or clients and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-transferable, non-sublicensable license to access and use the Site and its content for the personal, non-commercial purpose of evaluating our services. This license does not include: (a) any resale or commercial use of the Site or Site Content; (b) the reproduction or republication of any project photography, renderings, or floor plans; (c) any derivative use of the Site or its content; (d) any downloading or copying of Site Content for the benefit of another contractor, developer, or competitor; or (e) any use of data mining, robots, scrapers, or similar data gathering and extraction tools.

All rights not expressly granted are reserved and retained by the Company or its licensors. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the prior written permission of the Company.

Inquiries & Consultations

The Site allows you to submit inquiries and request a no-cost initial consultation. Submitting an inquiry does not create a contractor-client relationship or a binding agreement of any kind. A binding agreement is only formed upon execution of a written construction contract or services agreement signed by an authorized representative of SEC Construction & Development, Inc.

You agree to provide accurate, current, and complete information when submitting inquiries through the Site, and to promptly update such information so that we may respond to and communicate with you effectively. Any project pricing, scope, timeline, or feasibility information communicated prior to a written contract is preliminary and non-binding.

Disclaimers

Your use of the Site is at your sole risk. The Site is provided on an “AS IS” and “AS AVAILABLE” basis. The Company expressly disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

The Company does not guarantee the accuracy, completeness, or usefulness of any information on the Site — including project photography, descriptions, square footage references, prior client statements, or service area lists — and you rely on such information at your own risk. Any material obtained through the use of the Site is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system, mobile device, or loss of data that results from the use of any such material.

No advice or information, whether oral or written, obtained from the Company or through or from the Site shall create any warranty not expressly stated in these Terms or in a signed construction contract.

Limitation of Liability

In no event shall the Company, its officers, directors, members, employees, contractors, or agents be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of Site Content; (ii) personal injury or property damage of any nature whatsoever resulting from your access to and use of the Site; (iii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iv) any interruption or cessation of transmission to or from the Site; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party; and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, e-mailed, transmitted, or otherwise made available via the Site — whether based on warranty, contract, tort, or any other legal theory, and whether or not the Company is advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your breach of these Terms.

Termination

The Company may terminate or suspend your access to the Site, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts. Failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms of Service

The Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use the Site after those revisions become effective, you agree to be bound by the revised Terms.
